[ES] Los criterios de adjudicación son instrumentos fundamentales en la contratación pública, ellos están dirigidos a identificar las ofertas que satisfacen mejor al interés público, de modo que garanticen que los recursos del Estado se utilicen de manera eficiente y transparente. Sin embargo, la variabilidad en la interpretación y ponderación de estos criterios pueden afectar la transparencia y objetividad en el proceso de adjudicación(Fueyo, 2014). Este Trabajo de Fin de Máster tiene por objetivo analizar la influencia de las características de la licitación en la adjudicación de los contratos. Dichas características representan los elementos técnicos que el órgano de contratación puede seleccionar en un proceso de licitación, bien porque son elegidas libremente por el órgano de contratación o porque vienen impuestas por otras circunstancias de entorno legal. Por ello, en primer lugar, se pretende analizar el papel real que los criterios de adjudicación poseen en la adjudicación de los contratos. En segundo lugar, mediante el uso de análisis estadísticos y técnicas de minería de datos se pretende identificar, por un lado, cómo las características de la licitación y las características de las actuaciones a llevar a cabo influyen en la selección de la mejor oferta y en aspectos como la calidad técnica, el precio y otros factores relevantes en el proceso. Los resultados revelan que, aunque el precio sigue siendo fundamental, los criterios técnicos son igualmente determinantes en la adjudicación de contratos. Respecto a los factores que influyen en la baja de adjudicación, se encuentran la fórmula económica, el peso de criterio precio y el tamaño del contrato. Por último, los factores que más influyen en la relación calidad precio son el tipo de infraestructura, el tipo de servicio y el peso del criterio juicio de valor.
[EN] Award criteria are fundamental tools in public procurement, aimed at identifying bids that best satisfy the public interest, ensuring that state resources are used efficiently and transparently. However, variability in the interpretation and weighting of these criteria can impact transparency and objectivity in the awarding process (Fueyo, 2014). This Master's Thesis aims to analyze the influence of tender characteristics on contract awards. These characteristics represent the technical elements that the contracting authority may select in a bidding process, either freely chosen by the contracting authority or imposed by other legal circumstances. Therefore, the first objective is to examine the actual role that award criteria play in contract awards. Secondly, through the use of statistical analysis and data mining techniques, the study seeks to identify, on the one hand, how the characteristics of the tender and the specifics of the actions to be performed impact the selection of the best bid and aspects such as technical quality, price, and other relevant factors in the process. The findings reveal that, although price remains fundamental, technical criteria are equally decisive in contract awards. Regarding the factors influencing the awarded price reduction, the economic formula, the weight of the price criterion, and the contract size were found to be significant. Lastly, the factors most impacting the quality-price relationship are the type of infrastructure, the type of service, and the weight assigned to qualitative assessment criteria.
